This End User License Agreement ("Agreement") governs your access to and use of ImmersiveDJ (the "Service").
By using the Service, you agree to be bound by this Agreement.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial DJ and listening purposes, subject to this Agreement.
The Service streams music from SoundCloud via their public API. Use of SoundCloud content through the Service is subject to SoundCloud's API Terms of Use and SoundCloud's general Terms of Use.
Important: SoundCloud's API may not be used for commercial purposes without explicit written agreement from SoundCloud. This Service is provided for personal, non-commercial use only.
The Service includes a limited catalogue of original or AI-generated music owned or commercially licensed by the Service operator.
This content is provided solely as a fallback when SoundCloud streaming limits are exceeded or SoundCloud services are temporarily unavailable.
This content may be streamed within the Service only and may be removed or replaced at any time. No download or redistribution rights are granted.
The Service permits users to load and play audio content from their own local storage or devices, and to load their own avatar files ("User-Provided Content").
The Service operator assumes no responsibility or liability for User-Provided Content.
Live Sessions let a DJ invite other people into a private room, using a room code or invite link, to listen together, talk by voice and appear as avatars. Rooms are invite-only and are not listed, searched or discoverable through the Service. Sessions are peer-to-peer: participants' devices connect directly to each other. The Service operator does not host, relay, monitor, moderate, record or store Live Sessions or anything said, shown or shared in them, and has no access to them. See the Privacy Policy for what is shared between participants.
In a Live Session the DJ's music mix is sent to the other people in the room. You may use this only for private listening among people you know. You must not record, copy, rebroadcast or redistribute the music, or play it to anyone outside that private setting. You must not use Live Sessions for commercial purposes, ticketed or paid events, or broadcasts. Music streamed from SoundCloud remains subject to section 3.1 and may not be publicly performed through the Service.
You are solely responsible for any licences needed for music you play to others. If you use your own audio files in a way that goes beyond private listening, it is up to you to obtain every licence that use requires, including performance rights.
You are solely responsible for your conduct in Live Sessions and for everything you say, show, play or share, including your display name, voice, avatar, movements and any content you provide. If you start a room (as the DJ), you are also responsible for whom you invite and for sharing your room code or invite link only with people you trust. You must not, in any Live Session:
We do not review material before it is shared in a Live Session, and we are not liable for any content transmitted between participants. Other participants are independent users and not our agents. We do not control, screen or endorse what they say or do, and we are not responsible for their conduct, content or what they do with information you share with them. Join rooms only with people you trust, and use the in-app tools: you can mute individual people for yourself, other people's avatars fade when they come too close to you, you can switch off your microphone at any time, and you can leave a room at any time.
If you experience or witness illegal or harmful conduct, leave the room and report it to us at info@aliveintech.com with the room code, date, time and what happened. If anyone is in danger, contact the police or emergency services first. We do not have access to Live Sessions, but we will act on reports as far as we are reasonably able, which may include cooperating with law enforcement.
If you believe music or other content is being shared in a Live Session in a way that infringes your rights, send a notice to info@aliveintech.com identifying the work, the content and how to contact you. If you receive a takedown notice about a track, you must stop playing that track in Live Sessions. We may stop any user from joining or starting Live Sessions, or from playing specific tracks through the Service.
To use Live Sessions you must be 18 or older, or be 13 or older (or the minimum age that applies in your country, if higher) and have your parent's or guardian's consent to this Agreement. Children under 13 may not use Live Sessions.
Live Sessions depend on your network and on third-party connection services that we do not control. They may be interrupted, degraded or unavailable at any time, and we may change or withdraw the feature without notice.
The avatar library contains third-party avatars made available by their creators under open licences (CC0 or equivalent public-domain-style terms); no ownership in them is granted to you by the Service. If you load your own avatar file, you confirm that you have the right to use it and to share it with the participants in your rooms, and that it is not offensive, infringing or harmful. Your own avatar file is sent directly to other participants so they can display you.
Using virtual or mixed reality can cause discomfort, motion sickness or injury. Keep your play area clear, stay aware of your physical surroundings and the people around you, take regular breaks, and follow your headset manufacturer's health and safety warnings. Keep the volume at a safe level. You use the Service at your own risk.
You agree not to:
Local analysis of User-Provided Content does not alter the user's responsibility to ensure lawful use of such content.
All rights, title, and interest in the Service, including software, design, and non–third-party content, remain with the Service operator or its licensors.
We may suspend or terminate access to the Service, or to Live Sessions, at any time if you violate this Agreement or applicable law.
The Service, including Live Sessions, is provided "as is" and "as available" without warranties of any kind, express or implied, including that it will be uninterrupted, secure or error-free. We make no warranty about the conduct of any participant or about any content shared by participants.
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the Service, or for any loss or harm arising from the conduct of, or content shared by, other participants in Live Sessions, or from any information you choose to share with them.
To the maximum extent permitted by law, our total liability to you for all claims arising from or relating to the Service is limited to the greater of the amount you paid us for the Service in the six months before the claim arose and £50.
Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for fraud, or your statutory rights as a consumer.
To the extent permitted by law, you agree to indemnify the Service operator against claims, losses and costs (including reasonable legal fees) arising from your breach of this Agreement, your conduct in Live Sessions, or content you share or play, including claims by other participants or rights holders.
We may update this Agreement from time to time. The "Last updated" date shows the latest version, and continued use of the Service constitutes acceptance of the updated Agreement.
This Agreement is governed by the laws of United Kingdom, without regard to conflict of law principles. If you are a consumer, you also keep the protection of any mandatory laws of the country where you live.
