End User License Agreement (EULA)

1. Acceptance of Terms

This End User License Agreement ("Agreement") governs your access to and use of ImmersiveDJ (the "Service").

By using the Service, you agree to be bound by this Agreement.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial DJ and listening purposes, subject to this Agreement.

3. Music Content

3.1 SoundCloud Content

The Service streams music from SoundCloud via their public API. Use of SoundCloud content through the Service is subject to SoundCloud's API Terms of Use and SoundCloud's general Terms of Use.

• SoundCloud content is provided via streaming only
• No ownership or download rights are granted
• SoundCloud tracks may not be recorded, copied, exported, or redistributed
• SoundCloud content may not be used to train or develop AI technology
• You must comply with all applicable SoundCloud terms and policies

Important: SoundCloud's API may not be used for commercial purposes without explicit written agreement from SoundCloud. This Service is provided for personal, non-commercial use only.

3.2 Original and AI-Generated Fallback Content

The Service includes a limited catalogue of original or AI-generated music owned or commercially licensed by the Service operator.

This content is provided solely as a fallback when SoundCloud streaming limits are exceeded or SoundCloud services are temporarily unavailable.

This content may be streamed within the Service only and may be removed or replaced at any time. No download or redistribution rights are granted.

4. User-Provided Content

The Service permits users to load and play audio content from their own local storage or devices ("User-Provided Content").

• You are solely responsible for User-Provided Content
• You confirm you own or have all necessary rights to use such content
• User-Provided Content may be analyzed locally on your device for waveform visualization and DJ functionality
• The Service does not upload, store, distribute, or publicly perform User-Provided Content

The Service operator assumes no responsibility or liability for User-Provided Content.

5. Restrictions

You agree not to:

• Download, record, or copy streamed music
• Circumvent playback or content protection mechanisms
• Use the Service for unlawful or infringing purposes
• Exploit the Service commercially without written permission

Local analysis of User-Provided Content does not alter the user's responsibility to ensure lawful use of such content.

6. Intellectual Property

All rights, title, and interest in the Service, including software, design, and non–third-party content, remain with the Service operator or its licensors.

7. Termination

We may suspend or terminate access to the Service at any time if you violate this Agreement or applicable law.

8. Disclaimer

The Service is provided "as is" without warranties of any kind, express or implied.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the Service.

10. Governing Law

This Agreement is governed by the laws of United Kingdom, without regard to conflict of law principles.
